Our Terms & Conditions of Service

1. Introduction

These Terms & Conditions govern the provision of house clearance, waste removal, and related services (“the Services”) by J&Z House Clearance Cardiff (“the Contractor”) to the customer (“the Client”).

By accepting a quotation, instructing works to proceed, or making payment, the Client agrees to be bound by these Terms & Conditions.


2. Scope of Works

The Contractor agrees to carry out the Services as outlined in the accepted quotation.

Unless otherwise agreed in writing, all items within the specified areas are deemed to be included in the clearance. It is the Client’s responsibility to clearly identify and remove any items they wish to retain prior to the commencement of works.

The Contractor shall not be held liable for the removal or disposal of items not clearly identified by the Client as excluded.


3. Customer Responsibilities

The Client is responsible for:

  • Providing safe and unobstructed access to the property
  • Ensuring all items for retention are clearly removed or marked prior to clearance
  • Confirming legal ownership or authority to dispose of all items within the property
  • Disclosing any known hazards or risks associated with the property or contents

The Contractor shall not be liable for any loss arising from the removal of items where instructions have not been clearly provided.


4. Ownership of Goods & Right to Dispose

By instructing the Contractor to carry out clearance works, the Client confirms that:

  • They are the legal owner of the items, or
  • They have full authority to instruct their removal and disposal

All items removed during the clearance become the property of the Contractor unless otherwise agreed in writing. The Contractor reserves the right to reuse, recycle, or dispose of such items at its discretion.

The Contractor shall not be held liable for any claims relating to ownership disputes after the clearance has been completed.


5. Utilities & Site Services

The Client must provide access to necessary utilities where required, including electricity and water.

Where the Contractor uses utilities at the property (including sockets, outbuildings, or external supplies), the Client is responsible for ensuring that:

  • Any connected appliances or systems are appropriately isolated or protected
  • The use of such utilities will not result in damage or loss

The Contractor shall not be liable for any loss or damage arising from the use, interruption, or disconnection of utilities. This includes, but is not limited to, damage to appliances such as freezers, refrigerators, or other electrical equipment.


6. Hazardous Materials

The Client must inform the Contractor in advance of any hazardous or potentially dangerous materials, including but not limited to:

  • Asbestos
  • Chemicals or solvents
  • Gas canisters
  • Biohazard waste (e.g. medical or bodily fluids)

The Contractor reserves the right to refuse removal of such items or to apply additional charges where specialist handling is required.

Failure to disclose hazardous materials may result in additional costs and/or termination of services.


7. Site Conditions & Access

The Client acknowledges that:

  • Properties may contain hidden hazards, structural weaknesses, or access restrictions
  • Clearance may involve working in confined spaces, lofts, basements, or outdoor areas

The Contractor shall not be held liable for:

  • Damage caused by pre-existing structural weaknesses
  • Unavoidable minor damage during the removal of bulky or fixed items
  • Delays or additional costs arising from restricted or unsafe access


8. Liability

To the fullest extent permitted by law, and subject to the requirement of reasonableness under the Consumer Rights Act 2015:

  • The Contractor shall not be liable for any indirect, incidental, or consequential loss or damage
  • This includes (but is not limited to) loss of use, loss of income, loss of valuables, or sentimental items not removed prior to clearance
  • The Contractor’s total liability for any claim arising in connection with the Services shall be limited to the total value of the works undertaken

Nothing in these Terms shall exclude or limit liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any matter which cannot be excluded under applicable law


9. Valuables & Personal Effects

The Client is responsible for removing all valuables, important documents, and sentimental items prior to the commencement of works.

This includes, but is not limited to:

  • Cash, jewellery, watches
  • Legal documents, passports, certificates
  • Digital devices or storage media

The Contractor shall not be liable for the loss of such items if they are left within the property and removed during the clearance.


10. Completion & Acceptance

Upon completion of the works, the Client is responsible for inspecting the property and raising any concerns within a reasonable timeframe.

Full payment constitutes:

  • Acceptance of the works as completed
  • Confirmation that the clearance has been carried out as agreed
  • Acceptance of these Terms & Conditions


11. Payment Terms

Payment terms will be outlined within the quotation or invoice.

Failure to make payment within agreed terms may result in:

  • Additional recovery costs
  • Interest applied to overdue balances where applicable
  • Legal action where necessary


12. Cancellations & Wasted Visits

Where the Client cancels within short notice or denies access at the agreed time, the Contractor reserves the right to charge for:

  • Lost time
  • Travel costs
  • Labour allocation


13. Force Majeure

The Contractor shall not be liable for delays or failure to perform due to events beyond reasonable control, including:

  • Severe weather
  • Access restrictions beyond control
  • Supply chain or disposal facility issues
  • Labour shortages


14. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of England and Wales.


15. Pre-Clearance Checklist (Customer Acknowledgement)

Prior to commencement, the Client confirms:

  • All items to be retained have been removed or clearly identified
  • The Contractor has authority to remove and dispose of remaining contents
  • Any hazards or special conditions have been disclosed
  • Utilities provided are safe for use
  • Access arrangements are confirmed
